Acceptance of these terms
These Terms of Service form an agreement between you and DecisionTier, operated by Atheonix. By accessing DecisionTier, creating an account, or purchasing a membership, you agree to these Terms and acknowledge the Privacy Policy and Refund Policy.
If you do not agree, do not use the service. If you use DecisionTier on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Eligibility and student accounts
You must be at least thirteen years old to use DecisionTier. If you are under eighteen or have not reached the age of majority where you live, you may use the service only with the permission and involvement of a parent or legal guardian.
You must provide accurate account information, keep your password and membership key confidential, and promptly update your email address. You are responsible for activity through your account unless you notify us that it has been compromised.
What DecisionTier provides
DecisionTier provides educational estimates and planning tools for admissions likelihood, school-list balance, cost, aid, debt, and related outcomes. Some features use public datasets from government agencies, accrediting bodies, or institutions. Some results also use modeling assumptions that are identified as estimates.
DecisionTier may offer free features and paid features. Features, datasets, and supported credentials may change as data becomes available or as we improve the product.
Estimates are not guarantees
Admissions estimates are not admission decisions. Cost and aid estimates are not bills, financial-aid offers, loan terms, or guarantees. Career, salary, employment, and return-on-investment figures are not promises of future results.
Data can be delayed, incomplete, suppressed, self-reported, or unavailable. Test-score bands may reflect only students who submitted scores. Institutions can change policies, prices, deadlines, and programs without notice. You must verify material information directly with the institution, FAFSA, applicable scholarship providers, and qualified financial or legal professionals.
Do not make an enrollment, borrowing, withdrawal, or other consequential decision solely from DecisionTier. We are not responsible for an institution decision, aid determination, missed deadline, or difference between an estimate and an actual result.
Six-month membership and payment
A DecisionTier membership costs $40 USD and provides access to identified paid features for six months from activation. It is a one-time purchase and does not renew automatically. There is no recurring subscription or cancellation fee.
You may purchase another six-month period. When an additional purchase activates while your current membership is active, the new period is added after the existing expiration date. Prices and included features may change for future purchases, but a change will not shorten an already active paid period.
Payments are processed by Stripe. You authorize Stripe and DecisionTier to process the amount shown at checkout, applicable taxes, and information needed to fulfill the purchase. Refunds are governed by the Refund Policy.
Acceptable use
You may use DecisionTier for personal educational planning and other lawful purposes. You may not:
- Access another person’s account, membership key, or saved information without permission.
- Share, sell, publish, or systematically distribute a membership key.
- Scrape, crawl, copy, or extract the service at a volume that burdens the service or creates a competing dataset or product.
- Reverse engineer, bypass access controls, interfere with security, or attempt to discover credentials or vulnerabilities without written authorization.
- Submit malware, unlawful content, false outcome reports, or identifying information about another person without permission.
- Use DecisionTier to discriminate unlawfully, misrepresent an admissions decision, or impersonate an institution or another person.
Your content and outcome reports
You retain ownership of information you submit. You give DecisionTier a limited license to host, process, reproduce, and analyze that information only as needed to operate, secure, support, and improve the service.
If you voluntarily submit an application outcome, you allow DecisionTier to use the outcome in deidentified or aggregate calibration analysis. Do not include names, email addresses, application identifiers, or confidential documents in optional notes. You represent that your submission is accurate to the best of your knowledge and that you have the right to provide it.
DecisionTier content and intellectual property
DecisionTier and its original software, design, branding, models, explanations, and presentation are owned by Atheonix or its licensors and are protected by applicable intellectual-property laws. Public-source facts remain subject to their source terms and are not claimed as exclusive property.
We grant you a limited, personal, non-exclusive, non-transferable, revocable right to use the service under these Terms. No other rights are granted.
Third-party services and sources
DecisionTier relies on third-party services and data sources, including Stripe, Cloudflare, Fly.io, the U.S. Department of Education, IPEDS, and the American Bar Association. We do not control third-party services, and their terms and privacy policies may apply to your interaction with them.
A link or reference to a school, source, or third-party service does not mean that party endorses DecisionTier or that DecisionTier endorses every statement or service offered by that party.
Suspension, termination, and account deletion
You may stop using DecisionTier at any time and may delete your account from the account page. We may suspend or terminate access when reasonably necessary to protect the service or other users, respond to fraud or a security threat, comply with law, or address a material violation of these Terms.
When an account is deleted or terminated, account access and sessions end. Provisions that by their nature should survive, including payment records, ownership, disclaimers, liability limits, and dispute terms, remain effective.
Availability and changes
We work to keep DecisionTier available and accurate, but we do not guarantee uninterrupted access, a particular response time, or permanent availability of any feature or dataset. Maintenance, provider failures, legal requirements, or security events may interrupt the service.
We may update the service and these Terms. If a material change affects an active paid membership, we will provide reasonable notice through the service or the account email. Continued use after updated Terms take effect means you accept the updated Terms.
Disclaimer of warranties
To the maximum extent permitted by law, DecisionTier is provided “as is” and “as available.” Atheonix disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that estimates are complete, current, error-free, or suitable as the sole basis for a decision.
Nothing in these Terms limits a warranty or consumer right that cannot legally be excluded.
Limitation of liability
To the maximum extent permitted by law, Atheonix and its owners, personnel, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost opportunities, admissions outcomes, aid, revenue, data, or goodwill arising from DecisionTier.
To the maximum extent permitted by law, the total liability arising from the service or these Terms will not exceed the greater of $100 USD or the amount you paid DecisionTier during the twelve months before the event giving rise to the claim. These limits do not apply where prohibited by law or to liability that cannot legally be limited.
Governing law and disputes
Unless mandatory consumer law requires otherwise, these Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law principles. Before filing a formal claim, you agree to contact support@atheonix.com and give us thirty days to try to resolve the issue informally.
If a dispute cannot be resolved informally, it may be brought in a court with lawful jurisdiction. These Terms do not require individual arbitration and do not waive any non-waivable right to participate in a class or representative action.
General terms and contact
If a provision of these Terms is unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent. We may transfer these Terms as part of a merger, financing, reorganization, or sale of the service.
These Terms, the Privacy Policy, and the Refund Policy are the entire agreement concerning DecisionTier unless a separate written agreement applies. Questions may be sent to support@atheonix.com.
